Understanding Search And Seizure
Gives the police officer a strong foundation for developing a clear understanding of the law of Search and Seizure. This foundation starts with an understanding of the history of the concept and proceeds through the modern application of Search and Seizure law in today's courts. Understanding Search and Seizure requires much more than simply memorizing rules or repeating dicta from Supreme Court cases. It requires an understanding of the thinking that goes into those cases. To do this the police officer must go beyond the mere words in a Search and Seizure decision and uncover the underlying meaning of those words and the principles they elucidate. By examining cases, we begin to understand how courts apply the law. We also see areas that judges often struggle with the most. In understanding both the expectations and struggles of the courts we can better prepare for the day to day application of Search and Seizure law.
